The petitioner is an accused in a case bearing Crime

Reason:
District Prayagraj, Uttar Pradesh for the offences punishable
under Sections 498A, 304B of the Indian Penal Code and Section
2
3/4 of the Dowry Prohibition Act. His 2nd bail application was
dismissed by the High Court. Being aggrieved, he approached
this Court. He has already undergone about 5 years in jail.
Heard learned counsel for the petitioner and the
respondent-State.
Notice has been issued in this matter on 25.04.2025 and
as per office report dated 15.07.2025, despite service of
notice no counter affidavit has been filed by the State.
According to the prosecution it is a case of hanging by
suicide.
Considering the period of incarceration of the petitioner
and the other relevant factors, we are of the opinion that a
case of bail is made out for the petitioner.
Accordingly, the petitioner is directed to be released on
bail forthwith on the usual terms and conditions to be decided
by the concerned Court.
The present petition shall stand disposed of in the above
terms along with all pending application(s).
