This is the first anticipatory bail application
under Section 482 of the Bhartiya Nagrik
Suraksha Sanhita, 2023 (BNSS) filed by the
applicant, who is apprehending his arrest in
connection with Crime No.30/2025 registered
at Police Station C.G. ACB/EOW Raipur
(C.G.) for the offence punishable under

Sections 420, 467, 468, 471, 120-B of the IPC
r/w Section 7 (C) of Prevention of Corruption
Act, 1988.
2. The prosecution case, in brief, is that on
23.04.2025, the Economic Offence Wings,
Raipur lodged FIR No.30/2025 against 8
persons and name of the present applicant
was also mentioned therein. The allegation
against the applicant is that the applicant who
was the then Tahsildar of Tahsil Abhanpur,
District Raipur (C.G.) passed certain orders
while acting as quasi judicial authority under
the Chhattisgarh Land Revenue Code, 1959
and split/divided the lands and its khasra
numbers for facilitating the land oustees to
receive higher compensation in respect of
those lands which were acquired by the Land
Acquisition Authority/Officer for construction of
National Highway (Bharatmala Project).
3. Counsel for the applicant submitted that the
identically situated co-accused has
approached this Court for grant of anticipatory

bail in MCRCA No.946/2025 (Lekh Ram
Dewangan Versus State of Chhattisgarh) and
this Court, on 01.07.2025, has passed an ad-
interim order staying his arrest in view of the
order passed by the Hon’ble Apex Court in
SLP No.9127/2025. Hence the present
applicant may also be granted the same
interim relief, as has been granted to the co-
accused and prays that the present case may
also be connected with MCRCA No.946/2025.
4. On the other hand, learned counsel for the
non-applicant/State pointed out that the
proclamation has been made on 28.06.2025,
wherein co-accused Lakheshwar Prasad had
been directed to appear before the trial Court
on 29.07.2025. Relying upon the judgment of
the Apex Court in the matter of State of
Madhya Pradesh vs Pradeep Sharma,
reported in (2014) 2 SCC 171, he states that
the applicant is not entitled for the anticipatory
bail in view of the proclamation being issued,
but the counsel for the applicant submitted

that though the proclamation has been issued
under Section 84 of BNSS Act, 2023 and the
applicant has to appear on 29.07.2025, but in
view of Section 84 (1) of B.N.S.S., the
applicant/accused has one month time to
appear before the authority concerned from
the date on which a proclamation has been
issued under Section 84 of B.N.S.S. and the
applicant would undertake to appear on
29.07.2025 before the concerned trial Court in
view of the proclamation issued, hence the
present applicant be granted same interim
relief, as has been granted to the identically
situated co-accused person.
5. I have heard learned counsel for the parties
and perused the material available on record.
6. Considering the facts and circumstances of
the case and further the fact that since the
other co-accused in MCRCA No.946/2025 has
already been granted the ad-interim relief,
therefore, the present applicant is also entitled
to get the same relief as he undertakes to

appear before the Court concerned on the
said date. Therefore, purely as an interim
measure, it is directed that the applicant shall
not be arrested in connection with Crime
No.30/2025 registered at Police Station C.G.
ACB/EOW Raipur (C.G.) for the offence
punishable under Sections 420, 467, 468, 471,
120-B of the IPC r/w Section 7 (C) of
Prevention of Corruption Act, 1988 till the next
date of hearing.
8. Let this matter be listed along with MCRCA
No.946/2025.
9. Meanwhile, the State counsel may file its
reply.
