2. Mr. G.C. Joshi, learned AGA with Mr. Prabhat
Kandpal, Mr. Rakesh Negi, learned Brief Holders, for the
State of Uttarakhand/1.
3. In the present C528 Application filed under Bhartiya
Nagarik Suraksha Sanhita, 2023, the Applicants have put a
challenge to the entire proceedings of Criminal Case No.2649
of 2025, “State Vs. Navneet Sharma and others” under
Sections 323, 354, 504, 506 and 498-A of IPC, and under
Section ¾ of Dowry Prohibition Act, which is pending before
the court of learned 1st Additional Chief Judicial Magistrate,
Dehradun.
4. Admit.
5. Considering the submissions advanced by the learned
counsel on behalf of the Applicants, an interference is being
called for in the matter.
6. Issue notice to the respondent no.2. Steps to be taken
within a week. Counter affidavit to be filed within a period of
three weeks.
7. Till the next date of listing, the entire proceedings of
Criminal Case No.2649 of 2025, “State Vs. Navneet Sharma
and others” under Sections 323, 354, 504, 506 and 498-A of
IPC, and under Section ¾ of Dowry Prohibition Act, which is
pending before the court of learned 1st Additional Chief
Judicial Magistrate, District Dehradun, shall remain stayed.
8. List this matter on 09th September, 2025.
