1. Mr. Sumant Sudan, Advocate appears and accepts notice vice Mr.

Vishal Sharma, learned DSGI for the respondent. He seeks and is

granted opportunity for filing objections by next date of hearing in the

main as well as in the interim application.

2. Heard learned counsel for the petitioner in respect of his prayer for

grant of interim pre-arrest bail. Also heard the learned appearing

counsel for the respondent and considered their rival submissions.

3. Learned counsel for the petitioner, during his arguments in respect of

the interim application, inter alia, submitted that after registration of

crime No. 7/2022 dated 24.02.2022 under Sections 8, 22 and 60 of

NDPS Act against one Mukhtar Ahmad Punchoo, from whom the

alleged contraband was recovered, the proprietor/authorised officer of

the petitioner-company was also questioned during investigation of the

case in 2022 and the complainant-NCB never till date accused the

petitioner-company of its involvement in the case, but now the

complainant-NCB is harassing the petitioner-company unnecessarily

at the trial stage of the complaint, which is pending before the Court of

learned Principal Sessions Judge, Samba only to wreck vengeance as

the petitioner-company had filed a complaint against the officials of

the complainant-Bureau. That the petitioner-company, which deals in

the marketing of one of the alleged contraband, Codeine based cough

syrup is not at all involved in the commission of the crime. That the

petitioner, who is son of the proprietor of the firm, commands a great

respect in the society and as such, his arrest is likely to injure his

reputation who will suffer from an irreparable loss in terms of the

same. That he shall abide by any conditions that may be imposed by

this Court.
