The instant application for bail under Section 483 of BNSS
(439 Cr.P.C.) has been filed by the petitioner who has been
arrested in connection with F.I.R. No.206/2023, registered at
Police Station Karwad, District – Jodhpur City East for the offences
under Sections 419, 420, 406, 467, 468, 471 & 120-B of the IPC
and Section 4, 5 & 6 of the Prize Chits and Money Circulation
Schemes (Banning) Act, 1978.
Heard learned counsel for the petitioner and learned Public
Prosecutor. Perused the material available on record.
Learned counsel for the petitioner submits that the petitioner
has been falsely implicated in this case. He further submits that
the offences alleged to have been committed by the petitioner are
triable by Court of Magistrate. It is submitted that the bail

application filed by the petitioner was rejected by the learned trial
Court on the basis of the privious criminal antecedents (five other
cases of similar nature). However, it is submitted that in all other
five cases, the petitioner has been enlarged on bail by a
Coordinate Bench of this Court vide order dated 17.07.2025,
passed in S.B. Criminal Misc. Bail Application No.7977/2025,
7978/2025, 7974/2025, 7975/2025 and 7982/2025.
Learned counsel for the petitioner further submits that the
charge-sheet has already been filed and the petitioner is in judicial
custody since 17.05.2025 and the trial of the case will take
sufficiently long time, therefore, the benefit of bail may be granted
to the accused-petitioner.
Per contra, learned Public Prosecutor vehemently opposes
the bail application and submits that looking to the criminal
antecedents of similar nature of the accused, the benefit of bail
may not be granted.
Having considered the rival submissions, facts and
circumstances of the case; considering that the offence are triable
by the Court of Magistrate; more specifically the fact that in other
similar cases, the benefit of bail has been granted to the petitioner
by the Coordinate Bench of this Court, without expressing any
opinion on merits/demerits of the case, this Court is inclined to
enlarge the petitioner on bail.
Consequently, the bail application under Section 483 of BNSS
(439 Cr.P.C.) is allowed. It is ordered that the accused-petitioner
Surendra Singh S/o Shri Chandra Singh, arrested in
connection with F.I.R. No.206/2023, registered at Police Station

Karwad, District – Jodhpur City East, shall be released on bail, if
not wanted in any other case, provided he furnishes a personal
bond of Rs.50,000/- and two sureties of Rs.25,000/- each, to the
satisfaction of learned trial court, for his appearance before that
court on each & every date of hearing and whenever called upon
to do so till completion of the trial.
