1. It is submitted by learned Public Prosecutor that in
pursuance of the order dated 11.06.2025, notice has duly been
served upon the respondent No.2 and in support of this, he
produced the report dated 23.06.2025 sent by the concerned
SHO. The same be taken on record.
2. This application for bail under Section 483 of BNSS (Section
439 Cr.P.C.) has been filed by the petitioner, who has been
arrested in connection with F.I.R. No.51/2025, registered at Police
Station Bichiwara, District Dungarpur, for the offences under
Sections 323, 341, 504, 354 (C) and 376/34 of IPC and Section 67
of Information Technology Act.

3. Heard learned counsel for the petitioner and learned Public
Prosecutor. Perused the material available on record.
4. It is contended by learned counsel for the petitioner that the
allegations levelled against the petitioner are false and fabricated.
5. Learned counsel for the petitioner submitted that the victim
(aged 29 years), in the FIR, as well as in her statements recorded
under Section 161 of Cr.P.C. (Section 180 BNSS) and Section 164
of Cr.P.C. (Section 183 BNSS), levelled allegations of repeated
rape against Sanjay Kumar S/o Babu Lal and of single instance of
rape against the present petitioner-Sanjay Kumar S/o Nema.
6. The statement of victim recorded under Section 164 of
Cr.P.C. (Section 183 BNSS) reads as under :-
“मैं, मेरे पति व मेरे दों बच्चे सन् 2023 में बिछीवाड़ा में किराये का
मकान लेकर रह रहे थे। मैं मेरे तीन साल के बेटे के साथ बिछीवाड़ा से अपने
ससुराल मोदर कमाण्डर जीप में बैठकर जा रही थी। रास्ते में संजय पिता बाबूलाल
निवासी बोसलाटी शराब पीकर जिस जीप में मैं बैठी थी उसके आगे अपनी कुज़र
गाड़ी लाकर लगा दी तथा हमारी जीप को रोक दिया। संजय ने मुझे जीप से
जबरदस्ती उतरवाकर उसकी कुजर गाड़ी में बैठा लिया था। संजय ने उसकी गाडी
चुण्डावाड़ा से पहले रोक दी। मैंने कहा कि गाड़ी क्यों रोकी तो उसने कहा कि मेरी
गाड़ी में कुछ खराबी आ गई है । मेरा फोन भी संजय ने ले लिया था। मैं काफी दे र
तक घर नहीं पहुं ची तो मेरे पति स्वयं की बोलेरो गाड़ी लेकर मुझे दे खने के लिए
निकले थे कि उन्हें रास्ते में संजय की गाड़ी में बैठा मेरा बच्चा नजर आया तो उन्होंने
गाड़ी रोकी। मेरे पति ने मुझे पुछा की तुम यहां गाड़ी में क्या कर रही हो। संजय ने
मेरे बेटे को गाड़ी से धकेल दिया और मेरे पति को धमकी दी कि तेरे बेटे को ले जा
वरना दोनों को जान से मार दू ं गा। उसके बाद मेरे पति मेरे बच्चे को लेकर चुप चाप
बिना कुछ कहे वहां से चले गए। संजय मुझे वहां से गाडी में बैठाकर खेरवाड़ा होते
हुए बोसलाटी उसके, घर पर ले गया। उसके घर पर संजय की पत्नी नहीं थी वह
पिहर गई हुई थी। संजय ने मुझे उसके घर पर एक दिन रखा था। संजय ने मेरे साथ
मेरी मर्जी विरूद्ध गलत काम किया। उसके बाद वह मुझे उदयपुर ले कर गया जहां
उसने एक कमरा किराये पर लिया था। उसने घर के लिए गेस की छोटी टं की,
बर्तन, रज्जाई, गद्दा, बिस्तर मेरे लिए नये कपड़े व राशन पानी लेकर आया था।
संजय ने मुझे उदयपुर में छः महीने तक अपने साथ रखा था। दिनां क
17.08.2023 को उदयपुर में रूकने के दौरान वह मुझे खेरवाड़ा कोर्ट में लेकर
आया और मेरे साथ कोर्ट मेरिज की। संजय ने मुझे धमकी दी कि यदि तु मुझसे
शादी नहीं करे गी तो तेरे बच्चे और तेरे पति को मार दे गा। उसके बाद संजय मुझे
फिर से उदयपुर ले कर गया। उसके बाद संजय मुझे ले कर छाणी खेरवाड़ा आया
जहां एक रूम किराये पर लिया था। छाणी खेरवाड़ा में हम ग्यारह महीने तक एक
साथ रहे थे। संजय कई बार उस कमरे पर उसके दोस्तों को लेकर आता और वहां
उनका खाना पीना व शराब पीते थे । एक दिन उसने मुझे भी जबरदस्ती शराब पीला
दी और अपने दोस्त संजय पिता नेमा कलासुआ के द्वारा रे प कराया गया साथ ही
उसकी वीडियों भी बनाई संजय पिता बाबूलाल मुझे रोज मारता था तथा इसी तरह
तंग व परे शान करता था। इस तरह में बहुत परे शान हो गई तो दिनां क
04.02.2025 को किसी तरह वहां से बाहर निकली। वहां से मैं मेरे पति के पास
मोदर आ गई। संजय मुझे फोन करके धमकी दे रहा था कि तु वापस आ जा नहीं तो
जान से मार दू ं गा। उसने मेरे पति को भी फोन करके कई बार धमकी दी है । संजय(Downloaded on 28/07/2025 at 09:33:01 PM)
[2025:RJ-JD:32527] (3 of 4) [CRLMB-6927/2025]की पत्नी भी मुझे फोन करके कहती थी कि तु वापस आ जा नहीं तो यह संजय पिता
बाबूलाल फां सी खा जायेगा। जिस पर मैंने उसे मना बोल दिया कि मैं नहीं आउं गी।
संजय ने मुझे धमकी दी कि तु नहीं आई तो तेरा वीडियो वायरल कर दू ं गा। मैंने
उसके बाद बात करना ही छोड़ दिया। संजय ने मेरी वीडियों छाप्पी गां व के किसी
ग्रुप में वायरल कर दिए थे। इस बात की शिकायत मैंने एस.पी. साहब डूंगरपुर में
की। मेरी पिटाई की फोटो व जो वीडियो वायरल हुए थे वह भी मैंने पुलिस को दिये
है । मुझे इसके अलावा और कुछ नहीं कहना है ।
नोट :- गवाह को उसके द्वारा दिए गए बयान पढ़कर सुनाया गए तो गवाह
ने सुनकर समझकर सही होना जाहिर किया। ”
7. Learned counsel has drawn the attention of this Court to the
fact that after investigation, the police filed a charge-sheet against
Sanjay Kumar S/o Babu Lal and Anand Kumar for bailable offences
and both have been enlarged on bail by the learned Additional
Chief Judicial Magistrate, Dungarpur, on furnishing a bond of
Rs.10,000/- each. It is also contended that the petitioner has been
in judicial custody since 25.02.2025 and that the charge-sheet has
already been filed.
8. Per contra, learned Public Prosecutor and learned counsel for
the complainant/respondent No.2 have vehemently opposed the
bail application.
9. Learned counsel for the complainant/respondent No.2 is not
in a position to refute the fact that the victim has levelled
allegations against Sanjay Kumar S/o Babu Lal in the FIR as well
as in her statements recorded under Section 161 of Cr.P.C.
(Section 180 BNSS) and Section 164 of Cr.P.C. (Section 183
BNSS). It is also not refuted by the complainant/respondent No.2
that the main accused Sanjay Kumar S/o Babu Lal against whom
the victim had made specific allegations of abduction and rape has
already been enlarged on bail along with the co-accused Anand
Kumar and the charge-sheet against them has been filed under
bailable offences.

10. Having considered the rival submissions and the overall facts
and circumstances of the case, particularly the fact that the
charge-sheet has already been filed after investigation and the
petitioner has been in custody since 25.02.2025, without
expressing any opinion on the merits or demerits of the case, this
Court is inclined to enlarge the petitioner on bail.
11. Consequently, the bail application under Section 483 of BNSS
(439 Cr.P.C.) is allowed. It is ordered that the accused-petitioner
Sanjay Kumar S/o Nema arrested in connection with F.I.R.
No.51/2025, registered at Police Station Bichiwara, District
Dungarpur, shall be released on bail, if not wanted in any other
case, provided he furnishes a personal bond of Rs.50,000/- and
two sureties of Rs.25,000/- each, to the satisfaction of learned
trial court, for his appearance before that court on each & every
date of hearing and whenever called upon to do so till completion
of the trial.
