1. Heard Shri Anuj Kumar Mishra, learned AGA appearing for the appellant-State of UP and perused the record.
2. Present government appeal has been preferred against the judgement and order dated 08.12.2021 passed by the learned Additional District and Sessions Judge/ Special Judge (POCSO Act), Amroha, in Special Sessions Trial No.126 of 2018 (State of U.P. Versus Rais and another), arising out of Case Crime No.102 of 2018, under Sections 363, 366, 376(D) IPC, Police Station Bacchrayun, District Amroha.
3. The prosecution story is that the complainant Yashvir Singh has given a written report at concerned police station stating therein that on 29.06.2018, the victim his daughter aged about 16 years was alone in the house as the complainant and his wife had gone outside, thereafter some unknown person had came at his house and enticed away his daughter and his daughter had also taken the mobile, when she had not returned back, then started searching her from post to pillar, but her whereabouts could not be ascertained. On the basis of the aforesaid, first information report of the present case was lodged against some unknown persons. Thereafter, the investigating officer after completing all formalities, collecting sufficient material evidence has submitted charge sheet.
