Instant application filed under Section 419(4) of Bharatiya Nagrik
Suraksha Sanhita (BNSS) is for grant of special leave to file appeal against
the judgement dated 17.05.2025 passed by the Court of Chief Judicial
Magistrate, Srinagar (for short “the Trial Court”) in a complaint titled as

“Union of India thorugh Drug Inspector CDSCO vs. Sanjeev Garg and

Ors.”whereby the Trial Court after observing that the offence under Section

18(a) (i) of the Drugs and Cosmetics Act, has not been established,
dismissed the complaint.

I have gone through the application as well as impugned judgement.
Case is made out for grant of leave to file appeal. Accordingly, leave
is granted.

CrlM No. 1012/2025 is disposed of.

Appeal is taken on board.
