The Court made the following:

ORDER:

The Criminal Petition has been filed under Sections 480 and 483 of the

BharatiyaNagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to

enlarge the petitioner/Accused No.1 on bail in Cr.No.131of 2025 of Santhapet

Police Station, SPSR Nellore District, registered against the

petitioner/accused No.1herein for the offence punishable under Section 8(c)

read with 20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act,

1985 (for brevity ‘the NDPS Act‘).

2. The case of the prosecution in nutshell is that on 20.06.2025 at 16.30

hours, on credible information, the Inspector of Police, SanthapetPolice

Station, Nellore District, along with his staff reached near Radha Krishna

Lodge, Railway Station Road, Nellore City and found accused in possession

of ganja. Then the police caught the accused and found 2 KGs of ganja in

their possession and arrested them on 20.06.2025 under cover of

panchanama.

3. Heard learned counsel for the petitioner and the learned Assistant

Public Prosecutor. Perused the record.

4. The petitioner/accused No.1 was allegedly found in possession of 2 kgs

of Ganja and the petitioner was arrested on 20.06.2025 and he has been in

judicial custody for the past 37 days.

5. The learned Assistant Public Prosecutor reported that there were no

adverse antecedents against the petitioner. Material portion of the

investigation is completed.

6. All the witnesses are official respondents.The question of the petitioner

tempering the evidence or hampering the investigation or threaten the

witnesses may not be arise.Considering the nature and gravity of the

allegations levelled against the petitioner and his alleged role played in this

case, the period of detention and the quantity of the contraband involved in

this case, this Court deems it fit to enlarge the petitioner on bail with the

following stringent conditions.

7. In the result, the criminal petition is allowed with the following

conditions:

i. The petitioner/accused No.1 shall be enlarged on bail subject

to his executing a bond for a sum of Rs.10,000/- (Rupees ten

thousand only), with two sureties each for the like sum each to

the satisfaction of the learned I Additional District and Sessions

Judge, Nellore.

ii. The petitioner/accused No.1shall appear before the

Station House Officer, SanthapetPolice Station, Nellore

District,on every Saturday in between 10:00 am and 05:00 pm,

till cognizance is taken by the learned the Trial Court.

iii. The petitioner/accused No.1 shall not leave the limits of the

District without prior permission from the learned I Additional

District and Sessions Judge, Nellore.

iv. The petitioner/accused No.1shall not commit or indulge in

commission of any offence in future.

v. The petitioner/accused No.1shall cooperate with the

investigating officer in further investigation of the case and shall

make themselves available for interrogation by the investigating

officer as and when required.

vi. The petitioner/accused No.1shall not, directly or indirectly,

make any inducement, threat or promise to any person

acquainted with the facts of the case so as to dissuade him/her

from disclosing such facts to the court or to any police officer.
