                          UPON hearing the counsel the Court made the following
                                           O R D E R

The petitioner is an accused in a case punishable under

Sections 363, 366, of the Indian Penal Code and Sections 3/4 of the

POCSO Act and Section 3(2)(va) of the SC/ST Act. Apprehending his

arrest, the petitioner is before this Court seeking anticipatory

It is informed to this Court that the petitioner was granted

interim bail by the High Court vide order dated 01.02.2024.

Thereafter, the chargesheet was filed. Though the petitioner was

not named in the FIR, but on an application filed under Section 319

by the prosecution, he was summoned, in which he had got an

anticipatory bail by the High Court.

Subsequently, the High Court has cancelled the bail for the

reason that the petitioner was not cooperating in the trial.

However, we have gone through the ordersheets of the trial court

from 07.02.2024 to 08.05.2025 which reveals that the petitioner has

been attending the court.

Under these circumstances, learned senior counsel appearing

for the petitioner would argue that there was no occasion to pass

such an order. Presently we set aside the order of the High Court,

but we direct the petitioner to seek regular bail from the court

concerned, as that would be the appropriate procedure the

petitioner must follow under the law. Since the trial has

commenced, the bail has to be considered by the trial court

considering, inter alia, that the petitioner is cooperating and

attending the trial, as it is being argued.

The petitioner shall move an application for bail before the

trial court concerned within one week from today. Till the bail

application is decided by the trial court, the interim protection

from arrest is granted to the petitioner shall continue, in

connection with FIR/Case Crime No. 06 of 2020 dated 14.01.2020

registered at Police Station Trilokpur, District Siddharthnagar,

Uttar Pradesh.

In view of above, the Special Leave Petition is disposed of.

Pending interlocutory application(s), if any, is/are disposed

of.
