1. These applications for bail under Section 483 of BNSS

(Section 439 Cr.P.C.) have been filed by the petitioners, who have

been arrested in connection with F.I.R. No.431/2024, registered at

Police Station Savina, District Udaipur, for the offence under

Sections 8/22 and 8/15 of NDPS Act.

2. Heard learned counsel for the petitioners and learned Public

Prosecutor. Perused the material available on record.

3. It is contended by both the learned counsel for the

petitioners that the petitioners have been falsely implicated in the

present case and at the time of the incident they are not present

at the scene of crime and as per the NDPS Act, the commercial

quantity of narcotic contraband MD is 50 gm and Poppy Straw is

50 kg; however, the quantity of narcotic contraband MD allegedly

recovered in this matter is 67.710 gms and 66.600 gms from the

petitioners Manoj and Manohar Lal respectively; which is

marginally above the prescribed commercial quantity and 69 gms

770 milligrams of Poppy Straw allegedly recovered from the

petitioner Manohar Lal; which is of below commercial quantity.

Learned counsel has drawn attention of this Court towards the

application preferred by the petitioners for summoning the CCTV

footage from where the contraband was seized and the mobile call

location/ CCTV footage of the petitioners has not been preferred in

application before the Additional Sessions Judge No.1, Udaipur.
