Item No.1
Court No. 26
CHC
CRA 242 of 2021
IA NO: CRAN/1/2021
CRAN/2/2025
In Re:- An application under Section 389(1) of the Code of
Criminal Procedure, 1973, and under Section 430 of the
Bharatiya Nagarik Suraksha Sanhita, 2023, for suspension
of sentence and grant of bail during the pendency of the
appeal.
And
In the matter of : Dilip Dey @ Dila
...... appellant
Ms. Anita Kaunda, Advocate
Mr. Anubrata Dutta, Advocate
...for the appellant
Mr. Debasish Roy, Ld. P.P.
Mr. Asif Dewan, Advocate
...for the State
1.
In course of hearing the appeal being C.R.A. 242 of 2021 it
transpires that, there is another appeal being CRA 729 of
2006 preferred a convict.
2. Ideally, both the appeals should be heard by the same Bench
in order to avoid conflict in judicial decisions and more
efficient management of judicial time.
3. In such circumstances, it would be appropriate to release
C.R.A. 242 of 2021 so that both the appeals may be heard by
the same Bench.
