1. The petitioner-wife and her father (petitioner No. 2) have
filed three petitions under Section 25 of the Code of Civil
Procedure, 1908 before this Court seeking transfer of (i)
CS/3097/2023, titled “Ishan Kakra vs. Ekta Verma & Anr.”; (ii)
CS/3096/2023, titled “Brijesh Kakra vs. Ekta Verma & Anr.”; and
(iii) CS/3098/2023, titled “Rohit Mehra vs. Ekta Verma & Anr.”,
all pending before the Court of Civil Judge (JD), Gurugram
District Courts, Gurugram, Haryana, to the Court of Civil Judge,
Karkardooma Courts, Delhi.
2. Petitioner No. 1 – Ekta Verma and the respondent – Brijesh
Kakra are present in person, while the other respondents – Ishan
Kakra and Rohit Mehra have joined through video conferencing.

parties were referred to the Supreme Court Mediation Centre vide

order dated 13.02.2025. By virtue of the mediation, the partieshave arrived at a settlement and Ekta Verma (petitioner No. 1-
wife), and Ishan Kakra (respondent-husband) have decided to part
ways on certain terms and conditions which are delineated in the
settlement agreement dated 02.07.2025 which has been signed by
all the parties, their counsel and the Mediator, copy of which
has been filed by the Supreme Court Mediation Centre.
4. Learned counsel for the parties also filed a joint
application being IA D. No. 173646/2025 with the following
prayers:
“i) pass a decree of divorce by mutual consent in
terms of Section 13B of the Hindu Marriage Act, 1955
read with Article 142 of the Constitution of India
in favour of Petitioner No.1 – Ekta Verma and the
Respondent-Ishan Kakra and
ii) Quash all criminal proceedings, complaints and
FIR initiated by the Parties against each other as
mentioned in para 9(a), (b), (d), (f), (h), (j),
(k), (m), (n), (o), (p), (q) & (r) of this
application.
iii) Disposed of all civil legal proceedings,
complaints pending before the Hon’ble Court,
authorities and department by and between the
parties as mentioned in paragraph 9 (c), (e), (g),
(i), (l) & (s) of this application, as withdrawn and
not pressed.
iv) Make the settlement agreement dated 2.7.2025 to
be part and parcel of the order to be passed by this
Hon’ble Court by invoking Article 142 of the
Constitution of India and
(v) Pass any other order and further orders as this

Hon’ble Court may deem fit and proper in the facts
and circumstances of the present
case.”
5. Further, the terms and conditions and the relevant
paragraphs as set out in Settlement Agreement dated 02.07.2025
are as under:
“6. That the parties, as aforesaid, filed Civil
Cases, Criminal Cases and Police Complaints etc,
against each other on various grounds.
7. That Shri Ishan Kakra filed Case No. MHA
2000/2022 filed under Sec 10 of Hindu Marriage Act,
1956 namely Ishan Kakra v/s Ekta Verma filed before
the Tis Hazari District Court, Delhi which has been
withdrawn by Ishan Kakra. Two Cases filed by Brijesh
Karka being CT 41157/2024 (Brijesh Kakra v/s Ekta
Verma) and CS/4211/2024 (Brijesh Kakra v/s Ekta Verma)
filed before the District Court Patiala House, Delhi
has been withdrawn by Brijesh Kakra. One case filed by
Neeru Rani being MC 163/2023 (Neeru Rani v/s Ekta
Verma) filed before Tis Hazari District Court, Delhi
has been dismissed with a cost of Rs. 50,000/- to be
payable to Ekta Verma. Hence no action is required to
be taken in respect of the aforementioned cases which
is only stated for reference purpose.
8. That Mr. Prem Nath Verma has not filed any Court
case against Mr. Ishan Kakra, Mr. Brijesh Kakra and
Mrs. Neeru Rani and Mr. Rohit Mehra.

It is undertaken by the parties that the abovementioned Police
Complaint etc shall not be pursued by the respective parties
before any of the authorities and shall be treated as closed
and withdrawn.
TERMS OF SETTLEMENT
A. It is agreed between the parties that in view
of irreconcilable difference between the parties
and irretrievable breakdown of marriage, even after
intervention of relatives and Ld. Mediator, the
marriage could not be reconciled between EKTA VERMA
and ISHAN KAKRA. Accordingly EKTA VERMA and ISHAN
KAKRA have decided not to stay together and have
agreed to part their ways by seeking Divorce
through Mutual Consent.
B. The Parties have agreed to move an appropriate
application before the Hon’ble Supreme Court of

India by making humble prayer before the Hon’bleSupreme Court of India for grant of decree of
divorce exercising its power under Article 142 of
the Constitution of India.
C. The parties have agreed to make a prayer to the
Hon’ble Supreme Court of India praying for disposal
of the civil cases mentioned in paragraph No. 9 –
c, e, g, i, l, s of this Memorandum of Settlement,
since the parties have agreed not to pursue the
said pending civil cases and have agreed to
withdraw the same from the respective Courts where
such civil cases are pending.
D. The parties have agreed to withdraw all the
criminal complaints and criminal cases and FIR’s
filed against each other and shall humbly pray
before the Hon’ble Supreme Court of India by moving
an appropriate application before the Hon’ble
Supreme Court of India for exercising its power
under Article 142 of Constitution of India for
quashing of the criminal cases and criminal
complaints filed by the parties as specifically
mentioned in paragraph No. 9 – a, b, d, f, h, j, k,
m, n, o, p, q, r of the settlement and pass
appropriate order for quashing the said criminal
cases and criminal complaints.
E. It is agreed between the parties that MR. ISHAN

KAKRA shall pay a sum of Rs. 28,00,000/- (RupeesTwenty Eight Lakhs Only) as FULL and FINAL
settlement towards permanent alimony, stridhan and
maintenance past present and future by way of
Demand draft to EKTA VERMA. The amount of Rs.
28,00,000/- (Rupees Twenty Eight Lakhs Only) by way
of demand draft shall be handed over to Ekta Verma
at the time hearing of the application under
article 142 of the Constitution of India. A copy of
the Demand draft shall be shared with Ekta Verma by
Ishan Kakra atleast one week before the date of
hearing so fixed before the Hon’ble Supreme Court
of India for hearing of the application Under
Article 142 of the Constitution of India to be
filed in the aforementioned Transfer Petitions.
F. That the amount of Rs. 28,00,000/- (Rupees
Twenty Eight Lakhs Only) includes the cost of Rs.
50,000/- (Rupees Fifty- thousand only) which was
directed to be paid as cost to Ekta Verma by Ms.
Neeru Rani, Mother of Ishan Kakra/husband in the
case being MC 163/2023 vide order dated 11.02.2025
as directed by the Court of MS. Shruti Sharma-II,
L.D M.M, Mahila Courts, Tis Hazari, Delhi.
G. It is agreed by the parties that the Joint
Application Under Section 142 of the Constitution
of India shall be prepared by the Advocate

representing Ekta Verma supported by affidavits ofall the parties to this Settlement.
H. It is agreed and undertaken by all the parties
to this Memorandum of Settlement that they shall
not make public, use, circulate, publish, share any
personal data or information, photo, video, call
recording, e-mail, WhatsApp chats, facebook,
instagram, telegram or any other communication
media related information and/or data of the
parties to this Memorandum of Settlement including
their family members, to any one or anybody,
publicly or privately or any other personal
information including the details of the Court
Cases / Police Complaints or any other Complaints
etc. to anyone or anybody in any form.
I. That all the Parties, above named, undertake
not to litigate amongst each other in any manner
whatsoever, with regard to their matrimonial
disputes in the future or any other dispute
whatsoever in country or other country. Parties
assure that there is no other Police complaint or
Court Case filed or pending anywhere in India filed
by the parties, as aforesaid or through their
family members, apart from the cases mentioned in
this Memorandum of Settlement.
J. It is agreed that in future, parties above

named, will not make any allegations against eachother privately or publicly on the past events /
instances and the parties, above named, will not
file any new litigation/ complaint against each
other in India or in any other country based on
past incidents. It is agreed by the parties that
any complaint by way of letters or email to any
Department or fora by either of the parties to this
Agreement and their family members shall stand
withdrawn and not pressed.
K. That the Parties, above named, agree and
undertake that they have settled all their disputes
and grievances against their family members,
amicably with each other. Further, they shall not
file any proceedings, whether criminal or civil,
against each other and/ or their family members.
L. By signing this agreement the parties, above
named, hereto solemnly state and affirm that they
have no further claims or demands against each
other and all the disputes and differences have
been settled by the parties, above named, hereto
through the process of Mediation.
M. The parties, above named, undertake before the
Hon’ble Supreme Court of India that the terms
agreed herein above shall be binding amongst the
parties referred to above and they shall strictly

adhere to and comply with the terms and conditionsset out in the above-mentioned Memorandum of
Settlement Agreement, which have been arrived with
free will of the parties without any coercion,
duress or collusion and parties undertake not to
raise any dispute whatsoever henceforth.
N. It is agreed amongst the parties that upon
acceptance of this Memorandum of Settlement by the
Hon’ble Supreme Court of India, in the event of
violation of any of the terms and conditions, as
aforesaid by the parties namely Ms. EKTA VERMA D/O
SHRI PREM NATH VERMA, SHRI PREM NATH VERMA S/O SHRI
RADHEY SHYAM VERMA, MR. ISHAN KAKRA S/O SHRI
BRIJESH KAKRA, Mr. BRIJESH KAKRA S/O LATE B.R.
KAKRA, MRS. NEERU RANI W/O SHRI BRIJESH KAKRA, MR.
ROHIT MEHRA S/O SH. KAPIL DEV, the party violating
and/or defaulting the terms of this agreement shall
be liable for Contempt of Court and shall be
entitled to revive all cases by either parties.
O. Terms of Settlement Agreement have been read
over and explained in detail to the parties, above
named, in English and Vernacular language in the
presence of their respective Counsels present today
during the mediation session.
P. That the parties are accordingly signing this
settlement agreement in presence of all named above

to authenticate their will to comply the same asagreed above.”
6. We have taken the Joint Application and Settlement
Agreement dated 02.07.2025 on record.
7. Having considered the matter in detail and having perused
the Settlement Agreement and Joint Application which is also
supported by the affidavits of Ekta Verma (petitioner No. 1-
wife), Prem Nath Verma (petitioner No. 2-father of Ekta Verma),
Ishan Kakra (respondent-husband), Brijesh Kakra (respondent-
father of Ishan Kakra), Rohit Mehra (respondent-family
acquittance of Ishan Kakra and party) and Neeru Rani, the mother
of Ishan Kakra, we are of the view that this is a fit case for
exercising power under Article 142 of the Constitution of India
to dissolve the marriage between Ekta Verma (petitioner No. 1-
wife) and Ishan Kakra (respondent-husband). Consequently, the
marriage between the parties which was solemnized on 03.05.2022,
stand dissolved by a decree of divorce by mutual consent.
8. All the civil and criminal cases/complaints pending inter
se the parties as per clause 9 of the Settlement Agreement dated
02.07.2025, shall stand quashed/disposed of/closed. FIR No.
0216 dated 03.06.2023 registered by petitioner No. 1, Ekta Verma
with Police Station – Vivek Vihar, District – Shahdra, Delhi
under Sections 498A/406/34 of the Indian Penal Code, 1860, shall
also stand quashed.
9. Learned counsel for the respondents has handed over Demand

Draft(s) of ₹28,00,000/- (Rupees twenty eight lakhs only) to the
learned counsel for the petitioners in the Court.
10. In view of the above, Transfer Petitions and Joint
Application being IA D. No. 173646/2025 are disposed of. The
Registry will draw a decree in the aforesaid terms.
11. It is further directed that the parties shall abide by the
terms of this settlement implicitly.
12. Pending applications(s), if any, are disposed of.
