1. Learned counsel for the petitioner has informed this Court

that the petitioner is alive.

2. Learned Public Prosecutor is not in a position to dispute the

above fact situation.

3. This criminal revision petition under Section 397 read with

Section 401 of Cr.P.C. has been preferred by the petitioner against

the judgment dated 10.08.2007 passed by learned Additional

Sessions Judge, Didwana (hereinafter to be referred as ‘the

appellate court’) in Criminal Appeal No.49/2002, whereby the said

appeal was partly allowed. The said appeal was filed against the

judgment dated 05.08.2002 passed by the learned Judicial

Magistrate, First Class, Ladnu (hereinafter to be referred as ‘the

trial court’) in Criminal Original Case No.173/1996.

3.1. Vide judgment dated 05.08.2002, the learned trial court

convicted and sentenced the petitioner as under :
