This is a very innocuous application made by the Union of India
for a minor modification of my judgment and order dated 2nd April, 2025.
Learned Advocate for the respondent prays for time to file the
vakalatnama and to properly instruct her senior in the matter.
In my view, no such exercise is necessary. The matter has been
pending for a long time and disposed of by this Court finally on 2nd April,
2025. It is high time that the petitioner-respondent gets the benefit of the
order upon its minor modification as prayed for by the learned Deputy
Solicitor General, Dr Mozika on behalf of the applicants-Union of India.
Considering the scheme of medical examination in Assam Rifles,
there is a minor mistake in the constitution of the Medical Board in the
said order dated 2nd April, 2025.
The part of the order in the second page of the order sheet “I
hereby constitute…..” is modified by inserting the phrase “from the panel
of doctors in the service of Assam Rifles” after “the Director General in
sub-paragraph (ii) of the said order.
In sub-paragraph (iii), let “specialist medical private practitioner”
be deleted and replaced by “a specialist/surgeon/physician to be

2025:MLHC:678nominated by the Director, North Eastern Indira Gandhi Regional
Institute of Health & Medical Sciences, Shillong”.
The reconstituted part of the said order after the above
modification is:
“I hereby constitute a Medical Board as follows:
(i) One medical specialist in the field from the State
government health service to be nominated by the
Meghalaya government;
(ii) One medical specialist from the panel of doctors in the
service of Assam Rifles to be nominated by the Director
General;
(iii) One shall be a specialist/surgeon/physician to be nominated
by the Director, North Eastern Indira Gandhi Regional
Institute of Health & Medical Sciences, Shillong.”
Compliance of the order to be effected within two months of
communication of this order. The order dated 2nd April, 2025 is modified
accordingly.
The review petition is, accordingly disposed of.
