O R D E R
1. The petitioner-wife has filed the petition under Section 25
of the Code of Civil Procedure, 1908 before this Court seeking
transfer of Divorce Petition filed under Section 13(1)(ia) of
the Hindu Marriage Act, 1955 bearing Matrimonial Case No. 1438
of 2024 titled as “Sumit Kumar son of Pradeep Kumar Sinha vs
Sucholita Ghosh wife of Sumit Kumar” pending before the Court of
Principal Judge, Family Court, Gautam Budh Nagar, UP to the
Court of Principal Judge, Family Court, Deoghar, Jharkhand.
2. During the pendency of aforesaid transfer petition, the
parties were referred to the Supreme Court Mediation Centre vide
order dated 26.03.2025. By virtue of the mediation, the parties
have arrived at a settlement and they have decided to settle the
dispute(s) and resume their marital life on certain terms and

3. The terms and conditions as set out in Settlement
Agreement dated 17.07.2025 are as under:
“4(i) That the Respondent-husband has voluntarily
agreed to deposit by way of demand draft in favour
of the Petitioner-wife a total sum of Rs.
3,00,000/- (Rupees Three Lakhs Only) out of which
Rs. 1,50,000/-(Rupees One Lakhs and Fifty Thousand
Only) on or 15.08.2025 and rest Rs. 1,50,000/-
(Rupees One Lakhs and Fifty Thousand Only) on or
before 15.11.2025 for well being and mental
satisfaction of the Petitioner/wife and child.
(ii) That the Respondent Husband as agreed to
handover all Gold Jewellery belongs to
Petitioner/wife and child on or before 02.10.2025.
(iii) Both the parties hereto confirm and declare
that they have, voluntarily and of their own free
will, decided to resume their marital life as
husband and wife.
(iv) The Petitioner-wife undertakes to end the
existing dispute and live together as husband and
wife and respect for each other.
(v) Both the parties have also agreed to forgive
and forget past differences and start their life
afresh and henceforth live peacefully and happily.
(vi) It is further agreed between the parties that
the Respondent-husband shall, bring his wife dated
on 03.10.2025 from parental home at District
Deoghar, Jharkhand or any other place mutually
decide.
(vii) Both the parties undertake to give due
respect to each other and maintain dignified
behaviour towards each other and their respective
families.
(viii) Subject to the aforesaid terms, the parties
have resolved all their disputes amicably and have
agreed that they will not have any further
grievances against each other or their respective
family members.

(ix) That parties have mutually agreed that in case
any dispute arises in future the Petitioner/wife
alongwith her child shall be at liberty to reside
separately from Respondent/Husband and the living
expenses if any will be borne by the
Respondent/husband.
(x) Both the parties hereby undertake to fulfill
all matrimonial obligations and responsibilities
once the Respondent-husband brings back his wife
dated on 03.10.2025.
5. Whereas the Parties have filed following cases
against each other:-
(i) Respondent/ Husband has filed divorce petition
no. 1438 of 2024, titled as Sumit Kumar Vs
Sucholita Ghosh, before the Principal Judge Family
Court at Gautam Budh Nagar, Uttar Pradesh.
(ii) Respondent/Husband has filed Case No.
1398/2022, titled as Sumit Kumar Vs Sucholita
Ghosh, pending before the Principal Judge Family
Court at Gautam Budh Nagar, Uttar Pradesh.
(iii) Respondent/Husband has filed a Case No. GW-
157/2023, titled as Sumit Kumar Vs Sucholita Ghosh,
pending before the Principal Judge Family Court at
Gautam Budh Nagar, Uttar Pradesh.
(iv) Respondent/Husband has filed a Case Complaint
No. 316/2024, titled as Sumit Kumar Vs Sucholita
Ghosh, pending before the Judicial Magistrate 1st
Class at Gautam Budh Nagar, Uttar Pradesh.
(v) Respondent/Husband has filed a Case bearing FIR
No. 887/2024 at Police Station, GB Nagar, Uttar
Pradesh.
(vi) Petitioner/wife has filed Case No. 314/2022,
titled as Sucholita Ghosh Vs Sumit Kumar, pending
before Family Court II, Additional Principal Judge
Deoghar, Jharkhand.
6. It is also agreed between the parties that they
shall withdraw all the respective cases mentioned
in para 2 filed by them against each other and
shall take all steps to put an end to all
civil/criminal litigation existing between the
parties within a period of one month after the
disposal of the present transfer petition by the
Hon’ble Supreme Court.

7. This agreement has been executed by both the
parties out of their freewill and without any
coercion, duress or collusion. The parties hereby
undertake to abide by the terms and conditions set
out in the above mentioned Agreement.
8. The said agreement has been explained to the
parties in vernacular and they have understood the
same.”
4. We have taken the Settlement Agreement dated 17.07.2025 on
record.
5. Having considered the matter in detail and having perused
the Settlement Agreement, we are of the opinion that the present
Transfer Petition can be disposed of in terms of the Settlement
Agreement and it is, accordingly disposed of in terms of the
Settlement Agreement.
6. It is further directed that the parties shall abide by the
terms of this settlement implicitly.
7. The Registry will draw a decree in the aforesaid terms.
8. Pending applications(s), if any, are disposed of.
