1. This application for bail under Section 483 of BNSS (Section

439 Cr.P.C.) has been filed by the petitioners, who have been

arrested in connection with C.R. No.57/2025, registered at Police

Station Sarwana, Jalore, for the offences under Sections 74,

109(1), 115(2), 126(2), 117(2), 118(2) and 3(5) of BNS, 2023.

2. Heard learned counsel for the parties and perused the material

available on record.

3. As per the prosecution story, while the complainant’s mother

was crossing the land of petitioners Anada Ram and Adu Ram,

both petitioners allegedly attacked the complainant’s mother. It is

alleged that petitioner Adu Ram was armed with a sharp weapon

(axe), while petitioner Anada Ram was armed with a lathi.

4. Learned Senior Counsel for the petitioners submits that he does

not wish to press the bail application at this stage on behalf of

petitioner No.2 – Adu Ram, who was allegedly armed with a sharp

weapon (axe). However, he seeks liberty to file a fresh bail

application after completion of investigation and filing of charge-

sheet by the Investigating Officer.

5. As regards petitioner No.1 – Anada Ram, learned Senior

Counsel submits that the petitioner has been falsely implicated in

this matter. It is contended that the allegations against him are

not grave in nature, as he was allegedly armed with a lathi and

the injuries attributed to injured are blunt in nature. It is further

submitted that the trial is likely to take a considerable time to

conclude.

6. Learned counsel for the complainant submits that he has no

objection to the bail application of petitioner No.2 – Adu Ram

being not pressed at this stage, but strongly opposes the bail

application of petitioner No.1 – Anada Ram. He submits that

petitioner No.1 caused a fracture injury to the leg of the

complainant’s mother, as evident from photographs available in

the case diary. Due to this injury, she is presently unable to move.

7. Learned Public Prosecutor has also vehemently opposed the

bail application and submits that both petitioners acted in

connivance, and therefore, are not entitled to the benefit of bail.

8. Having considered the rival submissions, the nature of

allegations and considering the fact that petitioner No.1 – Anada

Ram is alleged to be armed with a lathi and the injuries attributed

by him are blunt and not dangerous to life, and taking into

account the likelihood of delay in conclusion of the trial, and

without expressing any opinion on the merits of the case, this

Court deems it just and proper to enlarge petitioner No.1 – Anada

Ram on bail.

9. Consequently, the bail application under Section 483 of BNSS

(439 Cr.P.C.) qua petitioner No.2 – Adu Ram is dismissed as not

pressed with liberty as prayed and petitioner No.1- Anada Ram is

allowed. It is ordered that the accused-petitioner No.1-Anada

Ram S/o Adu Ram, arrested in connection with C.R.

No.57/2025, registered at Police Station Sarwana, Jalore, shall be

released on bail, if not wanted in any other case, provided he

furnishes a personal bond of Rs.50,000/- and two sureties of

Rs.25,000/- each, to the satisfaction of learned trial court, for his

appearance before that court on each & every date of hearing and

whenever called upon to do so till completion of the trial.
