Heard the learned counsel appearing for the
parties and perused the counter affidavit.
The appellant seeks bail in connection with
Crime No.828/2023 registered at Police Station-
Chourai, District Chhindwara, Madhya Pradesh for
the offences punishable under Sections 294, 323,
324, 325, 302, 506 and 34 of the Indian Penal Code
(for short the ‘IPC’).
The case of the prosecution is that pursuant
to a scuffle that took place, the accused persons
attacked the deceased with a stick. Learned

counsel appearing for the respondent submits that
the trial has already begun.
Taking into consideration the overt act
attributed to the appellant, coupled with the
period of incarceration undergone, we are inclined
to grant bail to the appellant.
Accordingly, the impugned order is set aside
and the appellant is granted bail on such terms
and conditions to the satisfaction of the Trial
Court.
The appeal stands allowed accordingly.
Pending applications, if any, shall stand
disposed of.
