01. The instant criminal appeal is filed challenging the judgment

and order dated 07/01/2016 passed by the learned Additional Sessions

Judge, Bhandara in Sessions Trial No.45/2008, wherein the present

appellant was convicted for the offence punishable under Section 302 read

with Section 149 of the Indian Penal Code (I.P.C.) and sentenced to suffer

rigorous imprisonment for life and also to pay fine of Rs.1,000/-, in default

to suffer rigorous imprisonment for three months. The present appellant

was also convicted for the offence punishable under Section 452 read with

Section 149 of I.P.C. and sentenced to suffer rigorous imprisonment for five

years and also to pay fine of Rs.1,000/-, in default to suffer rigorous

imprisonment for three months.
