1. This Transfer Petition has been filed by the

petitioner-wife under Section 25 of the Code of Civil

Procedure, 1908 seeking transfer of case bearing OP (G&W)

No.1036/2024 under Section 25 of the Guardians and Wards Act,

1890 read with Section 3(1)(a) of the Family Courts Act, 1984,

titled ‘Sajitha B.L. Vs. Prasanthkumar K.P., pending before

the Family Court, Ernakulam, Kerala to the Family Court,

Hyderabad, Telangana.

2. We have heard the learned counsel for the parties.

3. Having considered the circumstances in their

justice, the transfer of the aforesaid proceedings, as prayed

for, is warranted.

4. Accordingly, this Transfer Petition is allowed and

the case bearing OP (G&W) No.1036/2024, titled ‘Sajitha B.L.

Vs. Prasanthkumar K.P., pending before the Family Court,

Ernakulam, Kerala is hereby transferred to the Family Court,

Hyderabad, Telangana.

5. It shall be open to the respondent to seek an

exemption from appearing physically, unless it is so warranted

by the Trial Court, and equally, it shall be open to the

petitioner to request for appearances through video

conferencing.

6. Further, the petitioner shall permit the respondent

to have visitation rights of the minor children on the second

Saturday of every month between 10.30 AM to 5.30 pm at the

place of the residence of the petitioner.

6. The records of the aforesaid case are to be

transferred to the Transferee Court forthwith.

7. All pending applications stand disposed of.
