In Re:- An application under Section 439 of the Criminal
Procedure Code, 1973 corresponding to Section 483 of the
Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with
C.Spl. Case No.50 of 2020 corresponding to Berhampore Police
Station Case No.620 of 2020 dated 29.06.2020 under Sections
376/370/372/373/34 of the Indian Penal Code and Sections
3/4/5/7 of I.T.P.A., 1965 and Sections 4/8/12/17 of the
Protection of Children from Sexual Offences Act and Section 75
of the J.J. Act pending before the Court of learned Judge,
Special (POCSO) Court, Murshidabad at Berhampore.

Service report along with memo of evidence filed on behalf
of the State is taken on record.
It is found that the victims under serial nos.8, 9 and 10 of
the memo of evidence has been served. The victims under serial
nos.1, 4, 5, 6, 7, 11 and 12 of memo of evidence are resident of
Bangladesh and they have not been served.
State is directed to serve notice upon the aforesaid victims
who are resident of Bangladesh through High Commission, India
to High Commission, Bangladesh.
State is further directed to serve notice upon the victims
under serial nos.13, 14 and 15 of memo of evidence and file a
service report on the next date. In the notice to be served by the
State, it should be mentioned that the victims have a right to be

represented through a lawyer to be engaged by the Calcutta
High Court Legal Services Committee for which no cost need be
borne by the victims. The notice should be in a language which
the victim can comprehend.
List this matter on 18th August, 2025.
