Petitioner is in jail and facing trial for the offences

punishable under Sections 143, 341, 323, 364 & 302 of the Indian

Penal Code. His 2nd bail application was dismissed by the High

Court. Being aggrieved, he had approached this Court.

Heard learned counsel for the parties.

We have been informed at the Bar by the learned counsel for

the State that out 49 witnesses, 5 witnesses are pending to be

examined by the prosecution; 4 have been deleted and as of now only

1 witness needs to be examined. Therefore, the trial is almost at

its end.

At this stage, we do not think a case of bail is made out for

the petitioner, in exercise of our jurisdiction under Article 136

of the Constitution of India.
