Learned senior counsel is pressing for the bail on the

ground that it is a peculiar case where the petitioner is

in custody for the last more than 4 years and one

month and the trial is not progressing.

2. Learned senior counsel has invited the attention of the

court to the various orders passed by the learned

Sessions Judge which displays the non-cooperative

attitude of the Public Prosecutor and the lethargy on

the part of the prosecution.

3. Learned senior counsel submits that for the fault of the

prosecution and hostile attitude of the defacto
complainant the petitioner cannot be forced to remain

in the custody.
