This is petition filed under Section 166 of Motor

Vehicles Act, 1988, seeking compensation of Rs.30,00,000/-

from the respondents, on account of death of Kenchavva,

who is wife of petitioner No.1 and mother of petitioners

No.2 and 3, in a road traffic accident.

2. The brief facts of the case are as follows:

On 24-09-2022 at about 10.30 a.m., the deceased

Kenchavva was proceeding on motorcycle bearing Reg.

No.KA-32-HB-4229 as a pillion rider, the same being ridden by

her building construction mestri. When they reached near

Pipeline road, Chikkagollarahatti, Dasanapura Hobli,

Bengaluru District, the rider of the said motorcycle rode the

same with high speed, in rash and negligent manner,

endangering the human life and proerty, without following

the traffic rules and ran over the road hump speedily. Due to

the said impact, the deceased fell down and sustained head

injury. Immediately after the accident, she was shifted to True

Life Speciality Hospital, Bengaluru, wherein during the course

of treatment she succumbed to said injuries on 25-09-2022.

Earlier to the accident, the deceased was working as coolie

and was earning Rs.20,000/- per month. She was contributing

her entire earnings to her family. Due to untimely death of a

sole bread earner, the petitioners are struggling for their

livelihood. The Madanayakanahalli Police have registered the

case against the driver of the said car for the offences

punishable under Section 279, 337 and 304(A) of I.P.C. The

respondent No.1 is the owner and respondent No.2 is the

insurer of the offending vehicle. Hence, they are jointly and

severally liable to pay compensation to the petitioners.

Therefore, it is prayed to allow the petition and award

compensation of Rs.30,00,000/- with interest at the rate of

18% per annum.
