The present petition is filed by the petitioners under
Sec.12 of Protection of Women from Domestic Violence
Act, 2005.
2. The brief facts of the petitioner’s case are as
under; The petitioner No.1 is the legally wedded wife of
respondent and from the wed lock they have 2 children.
At present elder son is major and he is in the custody of
the respondent and 2nd child aged about 17 years at the
time of filing he is in the custody of the petitioner.
Further she submitted that, entire marriage expenses
were borne by her parents. After the marriage 1 st

petitioner was happy with the respondent only for few
years there was quarrel between both of them regularly.
The parents of the 1st petitioner are taking care of the 1 st
petitioner and spending amount towards her medical
and check up expenses and education of her children.
The respondent is of suspicious of the character of the 1 st
petitioner and he used to harass the 1st petitioner both
physically and mentally. Under the aforesaid facts and
circumstances and being unable to bear the torture and
harassment given by the respondent the 1 st petitioner
was constrained to leave the matrimonial home.
