16. This matter is taken up through hybrid mode.

2. This application has been filed for recall of the order
dated 11.01.2024, vide which the LAA No.82 of 2017 stood
dismissed as withdrawn.

3. Mr. Jena, learned ASC for the State so also Mr. Baral,
learned Counsel for the Respondent Nos.4(a) to 4(d)
submit, they have already filed written objections opposing
to such prayer for recall of the order dated 11.01.2024.

4. As is ascertained from the record, during pendency of
LA Case No.1 of 2015, the present Appellant, who is the LR
of Applicant in the said case, filed an application under
Order 1 Rule 10 of the CPC before the referral Court to be
impleaded as parties, as the Applicant died on 24.04.2014.
While dealing with the said application, the impugned order
dated 11.04.2017 was passed by the Court below rejecting
the said application on the ground that such an application
has been filed beyond the limitation period without filing
any application for condonation of delay in terms of Section
5 & 14 of the Indian Limitation Act.
