1. Heard learned counsel for the parties.

The instant Criminal Appeal under Section 374 (2) Cr.P.C. has been filed by the appellant namely Ram Mahesh aged about 47 years s/o Ram Suchit challenging the judgment and order 31.03.2009 passed by the Additional Sessions Judge/Fast Track Court No. 7, District-Pratapgarh in Session Trial No. 227 of 1993, arising out of Crime No. 121 of 1993, under Sections- 323/504/506/427 IPC and 3(1)(x) of SC/ST Act, P.S.-Jethwara, District-Pratapgarh, thereby convicting and sentencing the appellant under Section 325 IPC for three years’ rigorous imprisonment with fine of Rs. 5000/- with default stipulation.

According to the case of prosecution in nutshell on 23.04.1993 at about 6 PM, the accused-appellant namely Ram Mahesh alongwith his brother assaulted the informant on his left hand and also hurled abuses and made casteist remarks. Thereafter on 23.04.1993 at about 7:30 PM the FIR was lodged at P.S.-Jethwara, District-Pratapgarh as Crime No. 121 of 1993, under Sections- 323/504/506/427 IPC and 3(1)(x) of SC/ST Act.
