Heard the learned counsel for the petitioner and the
learned counsel for the State.
2. This writ petition has been filed for the following
reliefs:
(i) For issuance of appropriate Writ/Writs,
direction/directions or orders/order, for
completion of investigation and forward to the
concerned Magistrate a report according to
Section 173 of Cr.P.C. in connection with
Patna High Court CR. WJC No.1626 of 2024(2) dt.07-08-2025
2/3Janta Bazaar P.S. Case No. 130 of 2022,
dated. 23/06/2022, registered under section
323, 379, 384, 420, 406, 467, 468, 471, and
120-B of The Indian Penal Code, 1860 and
section 27 of The Arms Act 1959;
(ii) For issuance of appropriate Writ/Writs,
direction/directions or orders/order to the
concerned respondents to conduct free and
fair investigation in the present matter to
secure the ends of justice;
(iii) For issuance of appropriate Writ/Writs,
direction/directions or orders/order to change
the investigating officer of Janta Bazaar P.S.
Case No. 130 of 2022 for the sake of proper
and fair investigation;
(iv) For issuance of appropriate Writ / Writs,
direction /directions or orders / order to the
concerned Respondents to investigate the
involvement of the District Transport Officer
at Patna and his office employees;
(v) For issuance of appropriate Writ/Writs,
direction/directions or orders/order to the
concerned respondents for the recovery of the
J.C.B bearing Registration No. BR-01GF-
8491, Chassis No. 01500272, Engine/Motor
No. H00134828, belonging to the
petitioner/informant;
(vi) For issuance of appropriate Writ/Writs,
direction/orders/order to the concerned
respondents to grant compensation of Rupees
Fifteen Lacs to the petitioner in order to
indemnify the benefit which would have
accrued to the petitioner from his JCB vehicle
bearing Registration No. BR-01GF-8491
andwas denied due to the negligence of the
investigating officer;
(vii) For issuance of appropriate Writ/Writs,
direction/directions or orders/order to cancel
the bail given to the accused person namely
Abhay Kumar vide order dated. 05/04/2024
(Annexure- P/11) by the Learned Court of
Sessions Judge at Chapra in ABP No. 4693 of
2023.

3. The learned counsel for the petitioner submits that
the investigation has been concluded and final form has been
submitted without proper investigation.
4. This application is disposed of with liberty to the
petitioner to approach the Superintendent of Police, Saran at
Chapra with his representation/application for further
investigation of the case in light of the materials which are
available on record and because the case has not been properly
investigated by the I.O. of the case.
5. If such a representation/application is filed before
the Superintendent of Police, Saran at Chapra, he will consider
the same and if he finds sufficient grounds for further
investigation, he will order for the same in accordance with the
law.
6. The application for further investigation, if filed by
the petitioner, must be disposed of within 15 days of its filing.
7. With the aforesaid observation(s) and direction(s),
this application is disposed of.
