1. Heard learned counsel for the applicants and learned Public
Prosecutor on the applications for suspension of sentence and

perused the material available on record.
2. Both these applications arise out of common order, hence
they are being decided by this common order.
3. Learned counsel appearing for the appellants has submitted
that the trial court has convicted the accused appellants for three
years Rigorous Imprisonment under the Prevention of Corruption
Act and that sentence was suspended by the trial Court itself. He
further submits that the appellants were on bail during trial and
disposal of the appeals may take considerable long time. The trial
court has not appreciated the evidence in proper manner.
Therefore, applications for suspension of sentence may be allowed
and appellants be released on bail.
4. The learned Public Prosecutor opposed the application for
suspension of sentence.
5. Taking into consideration all the facts and circumstances of
the case and in backdrop of arguments advanced by learned
counsel for the appellants especially the fact that appellants are
on bail during trial and disposal of the appeals is likely to take
considerable time but without expressing any opinion on merits of
the case, I am inclined to suspend the sentence of the appellants
Kamlesh and Dr Sahiram awarded by judgment dated 28.7.2025
in Sessions Case No. 2/2020.
6. It is, therefore, ordered that the sentence of the appellants
shall remain suspended till disposal of the appeal and they shall
be released on bail, provided each of them furnishes a personal
bond in the sum of Rs.50,000/- with two sureties in the sum of

Rs.25,000/- each, to the satisfaction of the trial Court to the effect
that he shall appear before this Court on 10.09.2025 and as and
when called upon to do so.
7. The applications are accordingly disposed of.
