The Criminal Petition has been filed under Sections 437 and 439 of

the Code of Criminal Procedure, 1973 (for brevity ‘the Cr.P.C.’)/ Sections

480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity

‘the BNSS’), seeking to enlarge the petitioner/Accused No.4 on bail in

Cr.No.38 of 2025 of Prohibition & Excise Station, Kadapa District,

registered against the petitioner/Accused No.4 herein for the offences

punishable under Section 8 (c) read with 20(b)(ii)(B) of the Narcotic Drugs

and Psychotropic Substances Act, 1985 (for brevity ‘the NDPS Act’).

2. The case of the prosecution is that on 31.05.2025, at about 08:00

A.M., on receipt of credible information regarding illegal possession of

ganja, the Inspector of Police, Prohibition & Excise Station, along with his

staff, secured the presence of mediators and conducted a raid near the old

bus stand to Ravindranagar Bridge in Kadapa Town, apprehending five

individuals, including the petitioner herein, who were allegedly found in

possession of contraband. Upon enquiry and search conducted in

compliance with procedural safeguards, it is alleged that the petitioner was

found in possession of a white plastic bag containing approximately 250

grams of dry ganja. The co-accused, A-1, was allegedly found with two kgs

of ganja in the dickey of his scooter, and it is further alleged that he had

distributed 250 grams each to the petitioner and other co-accused for the

purpose of resale. Based on their purported voluntary confessions, all the

accused were arrested, and the contraband was seized under a

mediatornama.
