01. 1. Heard learned counsel for the Petitioner and
learned counsel for the State.
2. The Petitioner is seeking pre-arrest bail in
connection with G.R. Case No.486 of 2024 pending in
the Court of learned JMFC-II (C.T.), Sambalpur arising
out of Dhama P.S. Case No.109 of 2024 for
commission of offence punishable under Sections 341/
324/ 452/ 506/ 324/ 307/ 34 of IPC.
3. Learned counsel for the State opposes such
prayer and submits that though the injury has been
categorized as simple and the Petitioner has following
criminal antecedents
“1. Dhanupali PS Case No 177 of 2021,
under Sections 339/402 IPC.
2. Dhanupali Case No 310 of 2021, under
Sections 339/402 IPC.

3. Dhanupali Case No 136 of 2025 u/s
276/277/3(5) BNS /52(a) OAE 2008.
4. Dhanupali Case No 157 of 2018, under
Sections 274/275IPC.
5. SadarPS Case No 269dt 25.12.2016 U/s
147/148/341/323/427/506/149 IPC.”
4. Taking note of the same, this Court is not
inclined to entertain the application for pre-arrest bail
in respect of Petitioner. However, it is directed that the
Petitioner may surrender before the learned JMFC-II
(C.T.),Sambalpur in connection with the
aforementioned case within one month from today.
In the event of his surrender and motion for
bail, the same be considered by the learned JMFC-II
(C.T.),Sambalpur on merits, in the first hour of the
day.
In the event of rejection of the prayer for bail by
the learned JMFC-II (C.T.),Sambalpur, the Petitioner is
at liberty to move the higher forum for bail in the
second hour on the same day.
5. On being so moved, the higher forum is
requested to make an endeavour to dispose of the bail
application of the Petitioner on the same day on merit
in accordance with law. `
The case diary shall be made available to the
concerned courts to facilitate disposal of the bail
application of the Petitioner and learned JMFC-II

(C.T.),Sambalpur is called upon to transmit the case
record to the higher forum at the earliest in the event
of rejection of such bail application.
Ground of Parity, if any, may be considered by
the learned court (s) below.
6. Accordingly, the ABLAPL stands disposed of.
