The present interim bail application under Section 483 BNSS
has been filed by the petitioner, who is in custody in connection
with FIR No.23/2024 registered at Police Station Deshnok, District
Bikaner for the offence punishable under Sections 363, 366A,
376(3), 376(D) IPC and Section 3/4(2), 5G/6 of the POCSO Act.
2. Learned counsel for the petitioner submits that petitioner’s
cousin has died and after his death, to perform last rites (asthi
visarjan), his presence, being cousin and only member in the
family to perform last rites, is required. It is, therefore, prayed
that the petitioner may be granted interim bail.
3. Learned Public Prosecutor has vehemently opposed the
present application for interim bail.
4. Having heard learned counsel for the petitioner as well as
learned Public Prosecutor, in the opinion of this Court, no plausible

ground has been raised in the present bail application and no case
for granting the interim bail to the petitioner is made out.
5. Consequently, the present bail application seeking interim
bail is hereby rejected.
