The present Application has been filed by the applicant

seeking anticipatory bail in Case Crime No.47 of 2024, registered

at Police Station Dharasu, District Uttarkashi.

2. Investigation is pending for the offence under Section

420 of the Indian Penal Code, 1860, Section 3 read with Section

21(1)(2)(3) of the Banning of Unregulated Deposit Schemes Act,

2019 and Section 3 of the Uttarakhand Protection of Interest of

Depositors (In Financial Establishments) Act, 2005.

3. As per the First Information Report dated 28.10.2024,

the informant and others opened their account in the applicant’s

Company, “Brahma Dev Nidhi Limited”. The informant deposited

money into his account. The owner of the company has refused

to return his money.

4. Heard Mr. Vikash Bahuguna, learned counsel for the

applicant and Mr. Tumul Nainwal, learned Assistant Government

Advocate for the respondent.

5. Mr. Vikas Bahuguna, Advocate, contended that the

applicant was not the owner / director of the company. He was

one of the employees of the said company. His salary was

Rs.15,000/- p.m. He was given salary for few months only. He

is also a victim. A sum of Rs.75,500/- has already been returned

to the victims. Applicant has no criminal antecedents. He is a

permanent resident of District Uttarakashi, therefore, there is no

possibility of his absconding.

6. Mr. Tumul Nainwal, Assistant Government Advocate,

has sought three weeks’ time to file objection to the anticipatory

bail application.

7. Time is granted.

8. Having heard the learned counsel for the parties and

in the facts and circumstances of the case, as an ad-interim

measure, it is directed that in the event of arrest of the applicant

Manveer Singh, he shall be released on interim bail on executing

a personal bond of Rs.30,000/- and two reliable sureties, each of

the like amount, to the satisfaction of the Investigating

Officer/Arresting Officer, subject to the following conditions:-

(i) Applicant shall cooperate with the Investigating
Agency and he shall make himself available for
interrogation by a police officer as and when required;

(ii) Applicant shall not directly or indirectly make any
inducement, threat or promise to any person
acquainted with the facts of this case;

(iii) Applicant shall not leave the country without the
previous permission of this Court.

9. List on 17.09.2025 for hearing on the anticipatory bail

application.
