04/18.08.2025 Heard learned counsel appearing for the petitioners as well as

the learned counsel appearing for the State.

2. The petitioners are apprehending their arrest in connection with

Borio(J) P.S. Case No.352 of 2018, for the alleged offences registered

under Sections 147, 148, 149, 323, 332, 333, 353, 379, 307, 504 and 506

of Indian Penal Code and Section 27 of Arms Act pending in the Court of

learned C.J.M., Sahibganj.

3. Learned counsel appearing for the petitioners submits that the

allegations are made that 100 persons were assembled at the place of

occurrence and 13 persons have been named in the FIR. He submits that

the petitioners have got no criminal antecedent as disclosed in paragraph

No.20 of the petition. He further submits that in identical situation one

co-accused has already been granted anticipatory bail in A.B.A. No.3193

of 2021.

4. Learned counsel appearing for the State opposes the prayer and

submits that the allegations are there against the petitioners of abusing

and scuffling with the police party.

5. Considering that 100 persons were assembled at the place of

occurrence and 13 persons have been named in the FIR and the

petitioner has got no criminal antecedent as disclosed in paragraph No.20

of the petition and one co-accused has already been granted anticipatory

bail in A.B.A. No.3193 of 2021, I am inclined to provide anticipatory bail

to the petitioner.

6. Accordingly, the petitioners, above named, are hereby directed

to surrender before the learned Court within three weeks from today, and

in the event of their surrender/arrest, the petitioners, above named, shall

be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees

Twenty Five Thousand) each, with two sureties of the like amount each,

to the satisfaction of learned C.J.M., Sahibganj in connection with

Borio(J) P.S. Case No.352 of 2018, subject to the conditions as laid down

under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
