This is the third application filed by the applicants under Section 483
o f Bharatiya Nagarik Suraksha Sanhita , 2023 for grant of regular bail
relating to FIR/Crime No.198/01 registered at Police Station-Forest
Department Maihar, District-Maihar (M.P.) for the offences punishable
under Sections 2, 9, 39, 49, 50, 51, 51A, 52, 57, 58J, 59, 60 of Indian Wild
Life Protection Act, 1972 and Section 2 read with Sections 58A, 20, 35, 36,
37 of Wild Life Protection Amendment Act, 2022. The applicants are in
custody since 09.12.2024. Earlier bail applications of the applicants were
dismissed as withdrawn vide order dated 22.04.2025 passed in M.Cr.C.
No.11634 of 2025 and M.Cr.C. No.17497 of 2025.
2. Learned counsel for the applicants has submitted that so-called tail
of the hunted animal leopard has been recovered from the applicants. Except

that, nothing is on the record. The applicants are in jail since 09.12.2024. The
trial will take time to be concluded, hence, the applicants are entitled to be
released on bail.
3. Learned counsel for the State has opposed the bail application and
submitted that there is solid evidence against the applicants, hence, no case
of bail is made out.
4. Heard the parties and perused the case diary.
5. It is a case of hunting of leopard. As per the report of Forest Officer,
it is clear that hunted leopard was found dead in the pond of the forest. No
body part of the hunted animal (leopard) was missing then the reason has not
been disclosed that why the applicants will hunt the leopard where the
applicants were having opportunity to move the corpus of the dead leopard.
6. Looking to the facts and circumstances of the case coupled with the
fact that the trial will take time to be concluded, this Court deems it
appropriate to enlarge the applicants on bail, therefore, without commenting
on the merits of the case, the application is allowed.
7. It is directed that applicants-Hanuman Kol, Bheem Kol,
Dharmendra Kol and Rajesh Rawat shall be released on bail on their
furnishing personal bond in a sum of Rs.50,000/- (Rupees Fifty Thousand
Only) each with one surety each in the like amount to the satisfaction of the
trial Court concerned for their appearance before the said Court on all such
dates as may be fixed by that Court in this regard during the pendency of
trial.
8. It is further directed that the applicants shall comply with the
