Heard learned counsel for the petitioners and the
State.
2. Petitioners apprehend arrest in a case registered for
the offences punishable under Sections 341, 323, 504, 307, 325,
379/34 of the Indian Penal Code.
3. As per F.I.R., petitioner no. 1 is alleged to have
assaulted on the hand of brother of the informant with iron rod.
It is further alleged that the accused persons also snatched gold
chain worth Rs. 70,000/- from the neck of brother of informant
and cash of Rs. 13,000/- from his pocket.
4. Learned counsel for the petitioners submits that
petitioners are innocent and have committed no offence. Though

there is allegation that petitioner no. 1 assaulted brother of
informant but there is no injury report on record to substantiate
the allegation and there is absolutely no allegation of assault
against petitioner no. 2. Rest of the allegations are ornamental
only to make the case grave. Petitioners are not accused in
Bakhtiyarpur P. S. Case No. 292 of 2014. Petitioners claim clean
antecedent.
5. Learned A.P.P. for the State vehemently opposed
the bail application.
6. Considering the aforesaid facts and circumstances
of the case, this anticipatory bail is allowed and it is ordered that
let the above named petitioners in the event of their
arrest/surrender before the court below within a period of eight
weeks from today, be enlarged on bail on furnishing bail-bond
of Rs. 10,000/- (ten thousand) each with two sureties of the like
amount each to the satisfaction of Chief Judicial Magistrate,
Saharsa in connection with Simri Bakhtiyarpur P. S. Case No.
199 of 2024, subject to condition as laid down under Section
482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
