Mr. Digvijay Singh Bisht, learned Legal Aid Counsel for the
Revisionist.
2. Ms. Ruchika Negi, learned counsel holding brief of Mr.
Sandeep Kothari, learned counsel for the Respondents.
3. Though time was sought as per the order sheet dated
05.05.2025, no objection has been filed on behalf of the
Respondents. It has been over two months since time was
granted for filing objections.
4. As per the office report dated 18.08.2025, objections have
still not been filed.
5. Learned Legal Aid Counsel prays for interim relief.
6. As an interim measure, it is directed that, till the next date
of listing, the further proceedings of Misc. Criminal Case No. 195
of 2022 and Criminal Case No. 205 of 2024, “Vinita Devi and
Others vs. Sanjay Dabral”, pending in the Court of learned Judicial
Magistrate, New Tehri, Tehri Garhwal arising out of Misc. Criminal
Case No. 286 of 2019, “Smt. Vinita Devi and Others vs. Sanjay
Dabral and Another”, filed under Sections 12/3, 17, 18, 19, 20, 21
and 22 of Protection of Women from Domestic Violence Act, 2005,
pending before the Court of Judicial Magistrate, New Tehri, Tehri
Garhwal shall remain stayed.
7. List this case on 08.09.2025.
8. In the meantime, further two weeks’ time is granted to the
Respondents for filing their objections.
9. It is made clear that no further time shall be granted, and
the matter shall be heard with or without objections.
10. Stay Application (I.A. No. 02 of 2025) stands disposed of
accordingly.
