This is a Claim Petition filed by the Petitioners under Section
166 of the Motor Vehicles Act seeking Compensation of
Rs.40,00,000/- for the death of Devaraju @ Devaraju.H.M S/o Mote
Gowda in a Road Traffic accident.
2. The Petition averments are as under:
As per the petition, petitioner no.1 is the wife and petitioner no.2
to 4 are the children of deceased Devaraju @ Devaraju.H.M. That on
10-12-2018 at about 2.10 p.m., while one Devaraju @ Devaraju.H.M,
a pedestrian was walking on the left-side of the road near Vijaya
bank, Koppa Town, Maddur Taluk, Mandya District, the rider of
Bajaj Pulsar Motor-cycle bearing No.KA-11-EL-9959 came from
behind in a rash and negligent manner and dashed against him. As
a result, Devaraju @ Devaraju.H.M fell-down and sustained
grievous-injuries. Immediately, Devaraju was shifted to Government
Hospital, Koppa, and then to NIMHANS, but during his treatment he
succumbed to the accidental injuries. Prior to the accident, Devaraju
was hale and healthy and he was doing Sericulture, earning
Rs.35,000/- per month. Respondent no.1 being the owner and
respondent no.2 being the insurer of the said motor-cycle are jointly
and severally liable to pay compensation to the Petitioners. Hence
this petition.
