21/08/2025 Heard Mr. Shishir Dixit, learned counsel for the
petitioner as well as Mr. Malay Jain, learned Panel
Lawyer, appearing for the State/ respondent No.1 and
perused the impugned F.I.R., charge-sheet and
materials brought on record.
It has been argued by learned counsel for the
petitioner that complainant / respondent No.2 is a
distance relative of the applicant, who has been

deserted by her husband and the petitioner, being the
relative of respondent No.2, got an alternative
arrangement for living and got a house rented and
thereafter, she did pay any rent etc. on account of
which, dispute arose between the petitioner and
respondent No.2. It is further submitted that earlier to
this the respondent No.2 is living a rented house, in
which Section 145 CrPC proceedings were initiated and
she was having some relationship with one Himant
Kumar Vaishnav for the last 8 years, the said house was
thereafter, vacated by her in view of the proceedings
pending before the SDM. He also submitted that
because of some dispute with the petitioner, son of the
petitioner was also assaulted by son of the respondent
No.2 / complainant, for which an FIR was lodged by the
son of the petitioner against the son of respondent No.2
for offence under Sections 127(1), 296, 115(2) and 3(5)
of the BNS, a copy of the said FIR has been annexed as
Annexure-P/9. It is stated that thereafter, the present
FIR has been lodged by the complainant / respondent

No.2 against the petitioner only to harass him and the
petitioner has already been allowed regular bail by the
trial Court itself.
Issue notice to the respondent No.2 by ordinary
post as well as registered post on payment of PF as per
rules. Notice be made returnable within four weeks.
List the matter thereafter.
Till the next date of listing, further criminal
proceedings in Criminal Case No. 5420 of 2025 pending
before the Court of Judicial Magistrate First Class,
Korba (C.G.) initiated in pursuance to the Final Report
No. 283/2025 dated 09.07.2025 submitted by Police
Station – Civil Lines, Korba (C.G.) for offence
punishable under Sections 69, 351(3) of BNS arising out
of FIR bearing Crime No. 300/2025 dated 19.05.2025
registered under Section 69, 351(3) of BNS, shall
remain stayed.
