1. Heard Sri Pankaj Saxena, learned AGA appearing for the appellant-State of UP and perused the record.

2. Present government appeal has been preferred against the judgement and order dated 02.07.2022 passed by the Additional District & Sessions Judge/Special Judge (Gangster Act), Court No. 4, Aligarh in Sessions Trial No.1907 of 2022, arising out of Case Crime No.203 of 2022, under Sections, 376, 406, 504 IPC, P.S. Akrabad, District Aligarh.

3. Prosecution story, in brief, is that a written complaint (Exhibit Ka-1) was submitted by the victim in Police Station Akrabad District Aligarh to the effect that the victim’s husband was addicted to drinking alcohol for a long time. During this time, Vishnu Sharma, son of Rampal Sharma, resident of Minauli Police Station Vijaygarh, started visiting her husband and after making her husband drink alcohol, got the 50 square yard inhabited land registered in his name without giving money to her husband and started living there and laid a trap at her house. Seeing the opportunity, he trapped her with sweet talks of love and had physical relations with her and kept promising marriage. He kept sexually exploiting the victim for about one and a half years. During this time, he also slowly took about 60 thousand rupees from the victim. When the victim asked him to marry her, the accused started abusing her and also refused to give the money.
