                                                                 ORDER

This is first application filed by the applicant under Section 439 of the
Cr.P.C./Section 483 of BNSS for grant of bail in connection with Crime
No.106 of 2023 registered at Police Station – Aron, District Gwalior (M.P.)
for the offences punishable under Sections 395, 436, 336, 427, 506, 147, 148,
149 of IPC, Sections 11 and 13 of MPDVPK Act and Sections 25, 27, 29 &
30 of the Arms Act.

Learned counsel for the applicant submits that the applicant is innocent

and has been falsely implicated. The present FIR has been lodged as a
counter-blast to FIR bearing Crime No.591 of 2023 registered against the
complainant party. It is contended that no injury has been caused on account
of the alleged gunshot fire, which was in the air. It is further submitted that at
the time of filing of the charge-sheet, Sections 25(1-B)(a), 27(1), 29 and 30
of the Arms Act have been added. The applicant is in custody since

25.05.2025. Investigation has already been concluded, therefore, no further
custodial interrogation is required. It is also submitted that co-accused
persons, namely, Raghuveer Singh @ Lallo, Ajab Singh, Raju Rawat,
Omprakash and Bharat Singh Rawat have already been granted bail by this
Court vide orders dated 02.04.2024, 22.02.2024, 19.04.2024 and 05.04.2024
respectively. On the ground of parity, the applicant, who is a permanent
resident of District Gwalior and there is no likelihood of his absconsion or
tampering with the prosecution evidence, deserves to be released on bail.

On the other hand, learned State counsel has opposed the application
and prayed for its rejection.

Heard learned counsel for the rival parties and perused the case diary.
Considering the facts and circumstances of the case, particularly the

fact that co-accused persons similarly situated have already been enlarged on
bail, but without expressing any opinion on the merits of the case, this Court
deems it proper to allow the application. Accordingly, it is directed that the
applicant be released on bail on furnishing a personal bond in the sum of
Rs.1,00,000/- (Rupees One Lakh only) with one solvent surety in the like
amount to the satisfaction of the trial Court/committal Court concerned
subject to compliance of the following conditions by the applicant:-

1) The applicant will comply with all the terms and
conditions of the bond executed by him/her;

2) The applicant will cooperate in the
investigation/trial, as the case may be;

3) The applicant will not indulge himself/herself in

extending inducement, threat or promise to any person
acquainted with the facts of the case so as to dissuade
him/her from disclosing such facts to the Court or to the
Police Officer, as the case may be;

4) The applicant shall not commit any other offence
during pendency of the trial, failing which, this bail order
shall stand cancelled automatically without further reference
to the Bench.

5) The applicant will not seek unnecessary
adjournments during the trial; and

6) The applicant will not leave India without previous
permission of the trial Court/Investigating Officer, as the case
may be.

State counsel is directed to send an e-copy of this order to the Station
House Officer of the concerned Police Station for information and necessary
action.
