The plaintiff has filed the suit for the relief of Declaration i.e.,

to declare the plaintiff is the absolute owner in possession of the suit

schedule property and cancellation of the Sale Deed dated

02.12.2015 claimed to be executed by the defendant No.2 in the

name of the defendant No.1 and also for Permanent injunction for

such other reliefs.

2. Brief facts of the plaintiff case as stated in the plaint is as

follows:

The plaintiff is the absolute owner and in possession of the

property bearing residential Site No.42, measuring East to west 40 Feet

and North to South 30 Feet, totally measuring 1200 Square Feet, formed

the converted land bearing Sy.No.60/1 and Sy.No.61/5. Originally the

suit schedule property was belonging to Sri. R.Kalidasa, S/o

Sri.Rajagopal, having purchased the same through the registered Sale

Deed dated 11/05/1981. Subsequently the above said Sri.R.Kalidasa,

represented through his GPA Holders Sri. Vikas Nanda and Sri.P.Kumar,

had sold the suit schedule property in favour of the plaintiff herein

through the registered Sale Deed dated 05/09/2005. After purchase, the

plaintiff was put in possession and enjoyment of the suit schedule

property and got changed the revenue records in his name before

Horamavu Grama Panchayath and it had issued House/Land Tax

Assessment Register for the year 2005-06 in the name of the plaintiff.
