This judgment is emerged consequent upon the

petition filed by the petitioners U/S 166 of M.V. Act,

claiming compensation on account of death of Smt.

Jayamma, in a road accident.

2. The case of the petitioners, in brief, are as

follows:

On 22.08.2024 at about 10.00 a.m., the Smt.

Jayamma was proceeding as a pillion rider on a motor

cycle bearing Reg. No.KA.52.W.5498 on NH-48 road, in

front of KEB office, Marohalli village, T Begur, Kasaba

(H), Nelamangala taluk, at that time the driver of the

Tipper Lorry bearing No. KA.52.C.0765 driven the same

at high speed, in a rash and negligent manner and

dashed against the motor cycle in which the deceased

was proceeding as a pillion rider from behind and caused

the accident. Due to which the Jayamma fell down and

the front wheel of the Lorry ran over the deceased and

sustained grievous injuries all over the body and

succumbed to the injuries on the spot. Thereafter the

dead body was shifted to Government hospital,

Nelamangala, wherein the doctors conducted

postmortem and handed over the body to the petitioners.
