1. The short grievance projected by the petitioner in this petition is
that the petitioner approached the District Magistrate, Ramban with
an application under Section 14 of the SARFAESI Act, 2002 for
taking over the possession of the secured assets belonging to
respondent no. 2, i.e., M/s Kashmir Forest Food. The application
was made on 04.02.2025, but the proceedings could not be initiated
because of the interim directions passed by this Court on
11.11.2024 in WP (C) No. 2678/2024.
2. It is submitted that the aforesaid interim directions were vacated by
this Court on 01.07.2025 giving liberty to the petitioner-bank to
proceed with the impugned notices dated 16.07.2024 and
22.10.2024 under Section 13(2) and 13(4) of the SARFAESI Act,
2002. On vacation of the interim directions, the petitioner claims
that they approached the District Magistrate, Ramban along with
the interim order dated 01.07.2025, but the District Magistrate,
Ramban has shown reluctance to proceed in the matter, though the
application was complete in all respects.
