The Court:
1. Affidavit of service is taken on record. Supplementary affidavit is also
taken on record.
2. This is an application for appointment of an arbitrator in terms of the
Dispute Resolution Clause mentioned in the invoices which were raised
by the petitioner on the respondent, in respect of supply of goods/TMT
bars and other metallic products. The petitioner claims to be a
manufacturer and supplier of TMT bars and metallic products. The
petitioner claims that the respondent wanted dealership of the
products. The parties agreed to such business transaction and it is
contended by the petitioner that substantial quantity of goods were
supplied to the proprietorship concern of the respondent.
