Mr. S. Bhandari, learned counsel for the appellant in Arb.A.

No. 1 of 2022 is present and wherein the said counsel submitted that this

appeal has been preferred under Section 37 of the Arbitration and

Conciliation Act, 1996.

In this matter, Mr. GN Sahewalla, learned counsel for the

respondents is present before the court physically. However, the said

counsel in this matter is submitting that subsequent to rendering the

judgment and award by the sole Arbitrator, the decree holder has initiated

the execution proceeding but the said execution proceeding has been

returned by the District Judge, Imphal East. This status which is submitted

by the learned counsel for the respondents is taken on record.

Whereas, the proceeding in MC(Arb.A.) No. 1 of 2022 has

been filed by the State of Manipur and wherein in this proceeding the

applicant is seeking for a direction to the respondents to deposit the award

amount but the said application is pending for consideration.

However, keeping in view of the fact that the aforesaid

miscellaneous application is pending for consideration are concerned, it is

deemed appropriate to clarify the position of Order 21 Rule 20 of CPC for

initiation of execution proceeding as it reveals in the aforesaid provision of

law. Hence, learned counsel for the parties in these proceedings be directed

to clarify the states of Order 21 Rul3e 10 of CPC even though judgment and

award has been rendered by the District Judge, Imphal East. Accordingly,

made an observation.

Hence, these matters would be listed on 25.09.2025.
