01. The Building Operation Controlling Authority
(BOCA) (Srinagar Municipal Corporation), by virtue
of an Order No. 545 of 2011 dated 29.09.2011
came to grant building permission in favour of the
respondent No. 1-Naseer Ahmad Dar for
construction of “double storeyed residential house
with attic after dismantling the existing two
storey attic house and single storeyed shop and
erection of compound walling” as shown in the
enclosed plans on a plot of land comprised in
khasra Nos. 919, 921, 922 and 927 in Estate
Bagath Shuroo commonly identified as Malla Bagh.
02. As per the said building permission Order No.
545 of 2011, Front Setback of 45 feet, Rear
Setback of 10 feet, One side Setback of 10 feet and
Other side setback of 10 feet were to be maintained
and kept for total plinth area construction was to be
1148 sq ft with building height permitted to be 32
feet.
