1. By this appeal, appellants herein are assailing the judgment dated
07.07.2025, read with order dated 25.07.2025, passed by the Court of learned
Principal District Judge, Budgam in case titled “Mushtaq Ahmad Kuchay and
Ors. Vs. JK Public School and Ors.” , whereby, the leave already granted to the
appellants under Section 92 has been revoked and the suit has been dismissed.
2. Learned counsel for the respondents Mr. Salih Pirzada has objected to the
maintainability of the appeal on the ground that first appeal is not maintainable
and the appellants had a remedy under Section 104 of CPC. For facility of
