3. Petition bearing No. CRL.M.C. 537/2025 under Section 528 of the
Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as
‘B.N.S.S.’) (old under Section 482 of the Code of Criminal Procedure, 1973)
(hereinafter referred to as ‘Cr.PC‘), has been filed on behalf of the
Petitioners, for quashing of FIR No. 404/2019 under Section 323/341/354/34
of the Indian Penal Code, 1860 (hereinafter referred to as ‘IPC‘) registered
at Police Station Sultan Puri; Petition bearing No. CRL.M.C. 538/2025
under Section 528 of B.N.S.S. (old Section 482 Cr.PC) has been filed on
behalf of the Petitioners for quashing of FIR No. 401/2019 under Section
323
/341/354/506/34 of IPC registered at Police Station Sultan Puri and
Petition bearing No. CRL.M.C. 1396/2025 under Section 528 of B.N.S.S.
(old Section 482 Cr.P.C.) has been filed on behalf of the Petitioners for
quashing of FIR No. 893/2017 under Section 324/341/34 of IPC, registered
at Police Station Sultan Puri and all the consequential proceedings
emanating therefrom, on the basis of the Settlement Deed dated 11.09.2019.

6. FIR No. 404/2019 and FIR No. 401/2019 are the cross-FIRs arising
from the same incident whereas the neighbours have some fight over a petty
incident of being hit by the motorcycle. FIR No. 893/2017 is also filed
between the same parties over some petty dispute.

7. On the Complaint of the Respondent No.2/Complainant, FIR No.
404/2019 under Section 323/341/354/34 of IPC dated 18.04.2019, got
registered at Police Station Sultan Puri against the Petitioners and on the
same day, FIR No. 401/2019 under Section 323/354/341/506/34 of IPC, got
registered against the family members of the Respondent No. 2 by the
Petitioners in CRL.M.C. 537/2025. On 19.12.2017, FIR No. 893/2017 under
Section 324/341/34 IPC, got registered at Police Station Sultan Puri against
the Petitioners in CRL.M.C. 1396/2025.

8. It is stated that the present Petitions mentioned above filed by both the
parties against each other, have been settled, without any consideration in
full and final settlement of all claims of the Complainant vide Memorandum
of Settlement (MOU) dated 11.09.2019, before the Mediation Centre, Rohini
Courts, Delhi. It is also settled between the parties that in terms of the
Settlement, there shall remain no dispute between them qua the present
Petitions and they will not bring any litigation against each other in future.

9. Today, the Complainants, who are present in the Court, state that they
have no objection if the said FIRs are quashed.

10. The parties are present before this Court in-person today, and have
been identified by their Counsel and Investigating Officer concerned and
they have entered into the Settlement voluntarily and without any fear and
coercion and undertake to remain bound by the terms of the said Settlement.

11. Considering the nature of the allegations and that they have settled the
matter, the FIR No. 404/2019 under Section 323/341/354/34 of IPC dated
18.04.2019, FIR No. 401/2019 under Section 323/354/341/506/34 of IPC
and the FIR No. 893/2017 under Section 324/341/34 IPC, registered at
Police Station Sultan Puri and all the consequential proceedings emanating
therefrom are quashed.

12. The Petitions are disposed of accordingly.
