Learned senior counsel for the appellants, Mr. Colin Gonsalves
is on record in the proceeding of W.A. No. 89 of 2023 which is connected
with the proceedings of MC(WA) No. 144 of 2023 and MC(WA) No. 62 of
2024, but represented by Mr. Lungmi Ragui, learned counse.
In this matter, learned senior counsel, Mr. M. Hemchandra;
learned senior counsel, Mr. N. Jotendro; learned senior counsel, Mr. Mr.
Rarry; learned counsel, Mr. Sanatomba and inclusive of learned counsel,
Mr. Ajoy Pebam are present before this Court physically, whereas, learned
DSGI, Mr. Kh. Samarjit is on record.

Whereas, the proceeding of MC(WA) No. 62 of 2024 is
seeking for amendment but the prayer column in the application reveals
that (A) seeking for allowing deletion of para 17(iii) of the impugned order
dated 27.03.2023 and (B) allowing applicants/appellants to add by way of
amendment paragraphs No. 7.8 to 7.13 as set out in this application as
paragraph No. 7.7 in the writ appeal.
However, keeping in view of prayer column in the application
proceeding as initiated by the applicants without mentioning any provision
of law for seeking amendment under relevant Code of Civil Procedure.
Therefore, the learned counsel for the applicants in this matter be directed
to clarify the prayer column (A) & (B) and which prayer is required to be
restricted to dispose of the application, if not, the matter would be dealt
with seriously.
Learned senior counsels for the respondents in this matter be
directed to clarify the status in the prayer column (A) & (B) in the aforesaid
proceeding for seeking amendment by instituting this proceeding.
Keeping in view of the prayer column (A) & (B) are concerned,
it is affecting the administration of justice.
Accordingly, made an observation.
Hence, these matters would be listed on 18.09.2025.
